These Terms & Conditions (“Terms”) apply to your use of the Fidgey Pidgey website at https://fidgey-pidgey.shop/ and to purchases made directly through our website.

Fidgey Pidgey is operated by MoveToDigital Software Inc. References to “Fidgey Pidgey,” “we,” “us,” or “our” in these Terms mean MoveToDigital Software Inc. operating as Fidgey Pidgey.

By using our website or placing an order, you agree to these Terms. Nothing in these Terms limits any rights you may have under applicable consumer protection laws.

1. Our Products

Fidgey Pidgey creates and sells collectibles, fidgets, articulated figures, accessories, gifts, and related products.

Many of our products are manufactured using additive manufacturing and similar small-batch production methods. Because of the manufacturing process:

• minor layer lines, texture differences, seams, or small surface variations may be visible;

• colours may vary slightly between production batches or from how they appear on a screen;

• multicolour placement and small cosmetic details may vary slightly from product photos;

• articulated parts may have minor differences in movement or fit between individual pieces.

These normal manufacturing variations are not necessarily product defects.

Product dimensions and other measurements shown on our website are approximate unless expressly stated otherwise.

2. Product Safety and Intended Use

Unless specifically stated otherwise on the product page, Fidgey Pidgey products are intended for users aged 14 and older.

Many products contain small parts and are not intended for young children. Products should not be placed in the mouth, used as food-contact products, or used for purposes for which they were not designed.

Customers are responsible for following any product-specific safety information displayed on the product page or provided with the product.

3. Product Information and Availability

We try to ensure that product descriptions, photographs, pricing, availability, specifications, and other information on our website are accurate.

However, occasional errors may occur.

We may correct typographical errors, inaccurate descriptions, pricing errors, or availability information when discovered, subject to applicable law.

Products may be changed, discontinued, temporarily unavailable, or replaced with updated versions without notice.

Adding an item to your cart does not reserve inventory.

4. Prices and Currency

Unless otherwise stated, prices displayed on our website are in Canadian dollars (CAD).

Applicable taxes, shipping charges, and any other charges will be shown during checkout before you submit your order.

Prices and promotions may change from time to time. A price change does not affect an order that has already been accepted, except where correction is permitted or required by applicable law.

Discount codes, promotions, bundles, and other offers may have additional conditions and may not be combined unless expressly stated.

5. Orders

Submitting an order is an offer to purchase the products listed in your order.

We may decline or cancel an order where reasonably necessary, including because of:

• product or material unavailability;

• an obvious pricing or listing error;

• payment authorization problems;

• suspected fraud or misuse;

• shipping restrictions;

• inability to manufacture a custom or selected configuration; or

• an order that violates these Terms.

If we cancel an order after payment has been collected, we will refund the affected amount using the original payment method, unless another method is agreed with you.

You are responsible for reviewing your cart, quantities, product selections, personalization information, shipping address, and other order information before submitting the order.

6. Payment

Payment must be completed using one of the payment methods made available during checkout.

Payment processing may be provided by third-party payment processors. We do not necessarily receive or store your complete payment-card information.

An order is not considered paid until the applicable payment provider confirms successful payment.

7. Production and Processing Times

Some Fidgey Pidgey products are produced or finished after an order is placed.

Processing and production times shown on the website are estimates rather than guaranteed delivery dates unless we expressly agree otherwise in writing.

Larger orders, customized products, high-demand periods, material shortages, equipment interruptions, or unusually complex products may require additional production time.

If a material delay affects your order, we will make reasonable efforts to communicate it to you.

8. Shipping and Delivery

Available shipping methods, charges, and estimated delivery information are displayed during checkout where applicable.

Estimated shipping or delivery dates are not guarantees. Carrier delays, customs processing, weather, incorrect addresses, and other circumstances outside our reasonable control may affect delivery.

Customers are responsible for providing a complete and accurate delivery address.

Where permitted by applicable law, additional shipping costs resulting from an incorrect or incomplete address provided by the customer may be charged to the customer.

For international orders, the customer may be responsible for customs duties, import taxes, brokerage charges, or other charges imposed by the destination country unless we expressly state that those charges are included.

Any taxes or duties collected by us or by a marketplace at checkout will be identified where applicable.

9. Damaged, Defective, or Incorrect Orders

If you receive an item that is materially damaged, defective, or different from what you ordered, please contact us promptly and provide:

• your order number;

• a description of the issue; and

• photographs where reasonably necessary to evaluate the problem.

Depending on the circumstances, we may offer a replacement, repair, refund, store credit, or another reasonable solution.

Normal characteristics of additive manufacturing described in Section 1 are not automatically considered defects.

Nothing in this section limits rights or remedies available to you under applicable law.

10. Returns, Cancellations, and Change of Mind

Because some Fidgey Pidgey products are manufactured, assembled, personalized, or prepared specifically for an order, return and cancellation eligibility may depend on the product and the stage of production.

Please contact us as soon as possible if you need to cancel or change an order. We cannot guarantee that an order can be changed or cancelled after production or fulfillment has begun.

Unless otherwise stated for a particular product or promotion, acceptance of a return for change of mind is determined according to the circumstances of the order and any return policy displayed on our website at the time of purchase.

Customized or personalized products may not be eligible for return solely because the customer changed their mind, subject always to rights provided by applicable law.

Nothing in these Terms removes any cancellation, refund, repair, replacement, or other right that cannot legally be excluded under applicable consumer protection legislation.

11. Custom and Personalized Products

Customers are responsible for checking names, text, design selections, colours, quantities, uploaded artwork, and other personalization instructions before submitting them.

We are not responsible for errors contained in personalization instructions supplied or approved by the customer.

We may refuse custom content that we reasonably believe is unlawful, infringes another person’s intellectual property rights, or is otherwise inappropriate for us to manufacture.

Where custom work requires separate design, development, approval, pricing, or production arrangements, additional terms contained in a quote, invoice, proposal, or written agreement may apply.

12. Wholesale and Business Orders

Fidgey Pidgey may offer wholesale pricing and ordering to approved business customers.

Wholesale purchases may be subject to separate terms, including minimum order quantities, pricing tiers, production timelines, shipping charges, resale requirements, payment terms, and other conditions displayed in our Wholesale Order Builder, quotation, invoice, or wholesale agreement.

Where separate wholesale terms have been agreed for a business transaction, those specific terms will govern that transaction to the extent they conflict with these general Terms.

Consumer protections that apply specifically to purchases made for personal, family, or household purposes may not apply in the same manner to purchases made for commercial resale.

13. Intellectual Property

Unless otherwise stated, the Fidgey Pidgey website, branding, logos, photography, written content, graphics, page designs, and other original website content are owned by or licensed to Fidgey Pidgey and are protected by applicable intellectual property laws.

Purchasing a physical product does not transfer copyright, trademark rights, design rights, or other intellectual property rights associated with that product.

You may not copy, reproduce, distribute, commercially exploit, scrape, or republish our website content without permission except where permitted by law.

Certain products or designs may be manufactured under licences from independent designers or other rights holders. Those rights remain with their respective owners.

14. Website Use

You agree not to use our website:

• for unlawful or fraudulent activity;

• to interfere with the operation or security of the website;

• to attempt unauthorized access to our systems or accounts;

• to collect information from the website using automated methods in a manner that disrupts the service;

• to impersonate another person; or
